Welcome to Gaviki ("we," "us," or "our"). We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will respond expeditiously to claims of copyright infringement committed using the gaviki.com website (the "Site") that are reported to our Designated Copyright Agent.

1. Copyright Ownership

All content published on gaviki.com by our team—including articles, design, text, graphics, logos, and software—is the property of Gaviki and is protected by international copyright laws. You may not reproduce, distribute, or create derivative works from our original content without express written permission from us.

If gaviki.com allows users to post content, users retain their copyright but grant Gaviki a license to display that content. Users are strictly prohibited from posting material that infringes on the intellectual property rights of third parties.

2. DMCA Notice of Alleged Infringement (Takedown Notice)

If you are a copyright owner, or are authorized to act on behalf of one, and you believe in good faith that your copyrighted work has been copied in a way that constitutes copyright infringement on our Site, please submit a formal DMCA Takedown Notice to our Designated Copyright Agent containing the following information:

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.
  2. Identification of the Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
  3. Identification of the Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., specific URLs).
  4. Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  5. Statement of Good Faith: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. DMCA Counter-Notice Procedure

If you believe that your content was removed (or access to it was disabled) by mistake or misidentification, you may submit a Counter-Notice to our Designated Copyright Agent. Your Counter-Notice must include the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, that you consent to jurisdiction of any judicial district in which Gaviki may be found), and that you will accept service of process from the person who provided the original takedown notice.

If we receive a valid Counter-Notice, we will forward it to the party who submitted the original Takedown Notice. If that party does not notify us within 10 to 14 business days that they have filed an action seeking a court order to restrain the user from engaging in infringing activity, we may restore the removed content.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Gaviki has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. Gaviki may also, at its sole discretion, limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, regardless of whether there is any repeat infringement.
